Holiday pay that is paid after 30 October 2012, irrespective of when it was accrued, can no longer benefit from the NI concession for employers and employees. As a consequence with effect from 31 October, ECIBA can only pay holiday money back to the originating employer. ECIBA will no longer be able to pay any operative directly after 26 October 2012. Transitional Changes What should you do if an Operative leaves your employment on or before 26 October 2012? You may choose to either pay the operative yourself for accrued holiday entitlement or advise ECIBA who will need to issue a cheque prior to 30 October 2012. In either case, you will need to notify ECIBA to avoid the position arising where an operative could be paid twice or not paid at all. You will need to do the following: Inform ECIBA immediately of any leavers and the date that they left, if you have not done so already. If you are a credits online user then you can make the amendment online. If you don’t use the on-line system a ‘leaver’ form will need to be completed and returned. Please make appropriate copies as required and e-mail the completed forms to [email protected] or fax back to 08450 343200 . If you pay the operative their holiday pay at the point of leaving you will need to recover that element held by ECIBA by completing and returning a holiday pay advance form or complete the holiday pay advance section in Credits Online (ensure you do this prior to entering the leave date for the operative). All these notifications will need to be received by ECIBA no later than 26 October. Failure to notify ECIBA by this date may result in you having to pay the operative the holiday pay after termination of employment, along with any employer National Insurance Contributions.

What should you do if an Operative leaves your employment between 26 October 2012 and 30 October 2012? For any operative leaving in this period you should pay any accrued holiday pay entitlement at the point of leaving. The holiday pay will benefit from the NI concession so long as it is paid by 30 October 2012. Inform ECIBA as soon as possible about the payment using a ‘Holiday Pay Advance’ form or the Credits Online System. You will then be reimbursed for the holiday pay accrued in the scheme. What should you do if an Operative leaves on or after 31 October 2012 It will be your responsibility to pay any outstanding holiday pay entitlement to operatives from this date. Employer and Employee NICs will now apply. ECIBA still needs to be notified as soon as possible of all operatives joining or leaving your employment. Taking advantage of the National Insurance Concession before 30 October 2012 Employers (with the operative’s agreement) may wish to take advantage of paying advance holiday pay for the Xmas period ahead of the cut-off date of the withdrawal of the NI concession. To take maximum advantage you will need to ensure that your credit purchasing up to week 53 is up to date. You will be able to claim the accrued funds in advance of the normal payout date. Continued Provision of Benefits for Graded Operatives It is important to note that although participation in the holiday pay scheme is no longer compulsory, continued participation in the JIB Benefits Scheme for Graded Operatives is an integral part of JIB Terms & Conditions.
